TRACT DESCRIPTIONS

Tract 1: 5.00± ac 1900S 2 Story four bedroom County Farm Home set upon 5+/- acres. The home has 1-1/2 baths, 2 large rooms on main floor plus kitchen and bedroom. 3 bedrooms upstairs with a full bath. The home features a large breezeway entrance with lots of storage area, replacement windows throughout, sits a basement with propane forced air furnace. There are several outbuildings to include: a 80 x 36 barn, a 66 x 20 machinery shed, a 26 x 20 grainery with corn crib sides, and a 26 x 22 detached garage. There is an electric hot water heater, sump pump, and water pump with two pressure tanks in the basement. The entry into the property is via a concrete bridge and driveway.

Tract 2: 8± ac SWING TRACT, directly behind the home and 5 acres. It is level tillable ground. It can be purchased only in combination with Tracts 1 or 3, or by an adjacent land owner. Combine this with Tract 1 for a 13 acre mini farm.

Tract 3: 13.5± ac Level Tillable Ground, with approximately 435 feet of road frontage. A crossing will need constructed across the open ditch along the road for access. This would offer a potential 13 acre building site.

PROCEDURE: Tracts 1 - 3 will be offered in individual tracts, and in any combination of these tracts, or as a total unit, subject to Swing Tract rules. There will be open bidding on all tracts and combinations during the auction as determined by the auctioneer. The property will be bid in the manner resulting in the highest total sale price.

DOWN PAYMENT: 10% Cash down payment at close of auction. Cash or cashiers check or a personal or corporate check immediately negotiable is satisfactory for the down payment.

YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING.

APPROVAL OF BID PRICES: At the close of the auction, Buyer(s) will be required to execute an Agreement to Purchase Real Estate and Addendum. The terms of this agreement and addendum are non-negotiable.

DEED and EVIDENCE OF TITLE : Seller shall provide a Personal Representatives deed and Owners Title Insurance Policy in the amount of the purchase price.

CLOSING: Balance of purchase price is due in cash at closing, which will take place on or before April 27, 2017. The cost for an insured closing will be shared 50/50 between Buyer and Seller.

POSSESSION: Possession is at closing.

REAL ESTATE TAXES: The Real Estate taxes shall be pro-rated to the date of closing. The Buyer(s) to pay all thereafter.

DITCH ASSESSMENTS: Buyer shall pay all ditch assessments due after closing.

ACREAGE: All acreage is approximate and has been estimated based on current legal descriptions and/or aerial photos.

SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in the auction. Any need for a new survey will be determined solely by the Seller, cost of the survey will be split 50/50 between Buyer and Seller. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres. In the event that the entire property sells to one buyer there shall be no survey.

EASEMENTS: All real estate is being sold subject to any existing recorded easements. Existing recorded leases, if any will be assigned to the Buyer.
