TRACT DESCRIPTIONS

Tract 1: 7.5± ac Home, Barn, Garage and 7.5+/- Acres. This ranch style home was originally built in the 1960s, then added onto and remodeled in the 70s and 80s. The home features a large family/dining room area for entertaining. A large bow window highlights this area! There are beautiful large Madison Cabinet built-in bookcases on each end of the area. PROCEDURE: Tracts 1- 4 will be offered in individual tracts, & in any combination of these tracts, or as a total unit, subject to Swing Tract rules. There will be open bidding on all tracts & combinations as determined by the auctioneer. The property will be bid in the manner resulting in the highest total sale price.

DOWN PAYMENT: Tract 1 and any combination with Tract 1: $5,000 down at the close of the auction and the balance at closing. Tracts 2 and 3, and 4: A 10% cash down payment is due at the close of auction. A cashiers check or a personal or corporate check immediately negotiable is satisfactory for the down payment. The balance of the purchase price is due in cash at closing.

ACCEPTANCE OF BID PRICES: The Successful Bidder will be required to enter into a purchase agreement at the auction site immediately following the close of the auction. Seller reserves the right to reject any and all bids.

EVIDENCE OF TITLE: Seller shall provide an owners title insurance policy in the amount of the purchase price.

DEED: Seller shall provide a Warranty Deed.

CLOSING: The targeted closing date will be approximately 30 days after the auction (or as soon as possible thereafter upon completion of the Final Title Commitment and Sellers closing documents). The closing agents fee for an administered closing will be shared equally (50:50) between Buyer and Seller. Buyer will pay any closing charges due to Buyer securing a mortgage.

POSSESSION: Possession of all tracts shall be delivered at closing.

REAL ESTATE TAXES: Real estate taxes shall be prorated to the date of closing. Buyer will assume and pay all assessments, including drainage assessments, if any, that are last payable without a penalty after the date of closing.

BUILDIND SITES: For purposes of building sites, Tracts 2 and 3 are being offered as a non-reviewed sell-offs by the Allen County Plan Commission. It will be the Buyers responsibility to apply for any Building permitting required by the Allen County Plan Commission, Allen County Building and Health Departments.

ACREAGE: All acreage, dimensions and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.

SURVEY: A new perimeter survey shall be prepared only if necessary to complete Title Commitment. Seller and successful bidder shall each pay half (50:50) of the cost of any survey. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance.
