PROPERTY LOCATION:
DIRECTIONS: From the north side of Chillicothe, IL (rail road tunnels), travel north on Illinois Rte 29 approximately one mile to Hart Lane. Travel west approximately 1 mile to the "Y"-intersection of Hart Lane and Galena Military Rd (also known as Ratliff Rd). Start watching for signs! From this "Y"-intersection, Tracts 1-3 are located approximately 3/4 of a mile west on Hart Lane, and Tracts 4-17 are located approximately 1/2 mile west on Galena Military Rd.


AUCTION LOCATION:
Three Sisters Park 17189 North Rte. 29 Chillicothe, IL. From Peoria and I-74: Travel North on Illinois Rte 6, then North on Illinois Rte 29 toward Chillicothe. The auction site is on the west side of Illinois 29 just south of Chillicothe.

PROPERTY DESCRIPTION:

TRACT 1: Located in Brown Deer Acres with frontage on Hart Lane.
TRACTS 2 & 4: Near Senachwine Creek, both offer wooded acreage for hunting/recreation and tillable acreage for crop income.
TRACT 3: Located just west of Fawn Hills subdivision, this mostly tillable tract includes some trees and offers the potential for an executive building site with scenic views.
TRACT 5: A balance of woods and tillable land adjacent to Fawn Hills subdivision. Consider combining with Tract 4 or Tract 6. (Contains easements for a water line for Fawn Hills and a gas pipeline.)
TRACTS 6 - 15: Already zoned residential and located along the wooded hillside just below the Fawn Hills ridge. Potential for scenic building sites in the country. Bid on an individual tract or a combination of tracts to create your own perfect get-away. (Tract 6 includes four individual tax parcels and Tracts 7-9 each include three individual tax parcels) Frontage along Galena Military Road.
TRACTS 16 & 17: Mostly tillable acreage with the balance in trees along Senachwine Creek, these tracts offer something for both the farmer and recreational enthusiast. Approximately 12 acres of Tract 17 are located on the south side of Senachwine Creek. (Tract 17 also contains easements for a water line for Fawn Hills and a gas pipeline.)
AUCTION TERMS & CONDITIONS:

PROCEDURE: The property will be offered in 17 individual tracts or in combinations. The property will be sold in the manner resulting in the highest total sale price.
DOWN PAYMENT: A 10% down payment of the total contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of a personal check, business check, or cashier's check. The balance of the contract purchase price is due in cash at closing. BIDDING IS NOT CONDITIONAL ON FINANCING.
BUYER'S PREMIUM: A ten percent (10%) Buyer's premium will be added to the final bid price to arrive at the total contract purchase price paid by the buyer.
ACCEPTANCE OF BID PRICES: All successful bidders will sign a purchase agreement at the auction site immediately following the close of bidding. All final bid prices are subject to the owner's approval. Such approval shall occur at the auction on auction day.
BUYER BROKER PARTICIPATION: A commission will be paid to any properly licensed Buyer Broker who registers a successful buyer according to the Broker Participation Guidelines. Broker Registration Forms are available from the Auction Information Office. Forms must be completed and returned no later than 48 hours prior to the auction.
CLOSING: Closing shall occur as soon as possible after applicable closing documents have been completed. Anticipated closing date is on or before November 20, 2007.
POSSESSION: Possession shall be given at closing subject to any remaining rights of the tenants. Leases have been terminated & lease-rights are open for the 2008 crop year.
TITLE: Seller shall provide an Owner's Policy of Title Insurance in the amount of the purchase price, and shall execute a proper deed conveying the real estate to the buyer(s). Seller shall pay the premium of the title insurance policy.
REAL ESTATE TAXES AND ASSESSMENTS: Seller shall be responsible for paying real estate taxes and assessments on the property for the 2006 and 2007 calendar year taxes, and buyer will be responsible for all taxes and assessments thereafter.
EASEMENTS AND LEASES: Sale of said property is subject to any and all easements of record and any and all government lease.
SURVEY: AT THE SELLER'S OPTION, the seller shall provide a new survey where there is no existing legal description. Any need for a new survey shall be determined solely by the seller. The seller will pay 100% of the cost if a survey is needed. The type of survey performed shall be at the seller's option and sufficient for providing title insurance.
MINERAL RIGHTS: The sale shall include all mineral rights owned by the seller, if any.
AGENCY: Westchester Auctions, LLC and its representatives are Exclusive Agents of the seller.
