    TRACTS 1-6 HAVE BEEN WITHDRAWN FROM THE AUCTION

    TRACT 1: 3 acres with 300ft of frontage on Yellow River Road. Potential building site.

    TRACT 5: 27 acres all tillable Morley-Blount-Pewamo soils with 25ft owned access from Yellow River Road.

    TRACT 10: 1.8 acres with 1136 sq. ft., single story, 3 bedroom home, detached 2 car garage, 54ft x 60ft barn and 300ft of frontage on Yellow River Road.






    AUCTION TERMS & CONDITIONS:

    PROCEDURE: The property will be offered in 10 individual tracts, any combination of tracts and as a total 209-acre unit. There will be open bidding on all tracts, subject to swing tract limitations, and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations, and the total property may compete.
    DOWN PAYMENT: 10% down payment on the day of auction. The down payment may be made in the form of cash, cashiers check, personal check, or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
    ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.
    EVIDENCE OF TITLE: Seller shall provide an owners title insurance policy in the amount of the purchase price.
    DEED: Seller shall provide General Warranty Deed(s).
    PERIMETER DRAIN TILE EASEMENT: If tracts of less than 10 acres sell separately, easement access will be provided over tracts in this property for perimeter drain tile outlets if perimeter drain tile outlets beyond each individual tract are required by the Allen County Health Department.
    CLOSING: The balance of the purchase price is due at closing, which will take place within 15 days of presentation of insurable title (prior to January 1, 2008). Costs for an insured closing shall be shared 50:50 between Buyer(s) and Seller.
    POSSESSION: Possession at closing, subject to tenants rights to harvest 2007 crops.
    REAL ESTATE TAXES: Real estate taxes will be the responsibility of the Buyer(s) beginning with taxes due in May 2009 and thereafter. Any ditch assessments after closing will be buyers responsibility.
    ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.
    SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Any need for a new survey shall be determined solely by the Seller. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres on any tract or combination of tracts greater than 10 acres. Closing prices of Tracts 4 & 9 or any combination that includes one of those tracts will not be adjusted, if a new survey is determined to be necessary by the Sellers. Combination purchases will receive a perimeter survey only. Immediately after closing Buyer(s) of Tracts 7 & 8 shall sign all appropriate documents at FSA required to transfer the CRP land. Buyer(s) will be responsible for the maintenance of the CRP land in the future. If the buyer(s) remove any acres from the CRP contract they are solely responsible for repayment of received payments, interest and penalties.
