West side of Quaker on 2650th Rd. and 2250th St. 17 mi. northeast of Paris or 9 mi. northeast of Chrisman near the Indiana State Line at Quaker. From Paris north on Hwy. 150/1 to Hwy. 36 then east to Hwy. 3 (1950E) then north to 2650th Rd. east 2-1/4 mi. to the property on both sides of the road.

PROPERTY DESCRIPTION:


Tract 1: 41 acres all level cropland with Drummer & Elburn soils.

Tract 2: 45 acres with est. 40 acres cropland (3) 5,000 Bu. bins and (1) 10,000 Bu. bin. Three older barns. Excellent Drummer and Flanagan soils. North boundary is the center of Jonathan Creek.

Tract 3: 30 acres all cropland Drummer and Flanagan soils. North boundary to be the center of Jonathan Creek.

Tract 4: 127 acres with 119 acres cropland and 6.48 acres in USDA filter strip Conservation Reserve Program. Top quality Drummer and Flanagan soils. Frontage on Co. Rd. 2250. South boundary is the center of Jonathan Creek. Buyer to assume CRP contract expiring 2008 and to receive 2008 CRP payments.

Tract 5: 56 acres all cropland. Excellent Drummer and Elburn soils.

Tract 6: 160 acres all cropland. Flanagan and Drummer soils. (Swing tract.) This tract must be bid by adjoining property owner or with Tract 5 combination.
AUCTION TERMS & CONDITIONS:

PROCEDURES: The property will be offered in 6 individual tracts, any combination of tracts, or as a total 459 acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Tract #6 may be bid only by adjoining landowner or in combination with Tract #5. Bids on tracts, tract combinations and the total property may compete.
DOWNPAYMENT: Real Estate 10% down payment on the day of the auction with the balance in cash at closing. The down payment may be made in the form of cash; cashiers check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: Successful bidder(s) will be required to enter into a purchase agreement at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.
EVIDENCE OF TITLE: Sellers shall provide an owners title insurance policy in the amount of the purchase price. Title Commitment is in Bidder Packet.
DEED: Sellers shall provide Warranty Deed.
CLOSING: The balance of the real estate purchase price is due at closing, which will take place within 15 days of presentation of title policy estimated on or before December 30, 2007.
POSSESSION: Possession of cropland on March 1, 2008. Bins and barns to be June 1, 2008.
REAL ESTATE TAXES: Estimated at $7,653.58/yr. Buyer to pay taxes beginning 2008 and thereafter.
ACREAGE: All boundaries are approximate and have been estimated based on current legal descriptions.
SURVEY: A new survey will be made where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Buyer(s) and Seller will share survey expense 50:50. Combination purchases will receive a perimeter survey only. Closing prices will be adjusted to reflect any differences between advertised and surveyed acreages.
FSA INFORMATION: Farm #3666, Total USDA Crop acres 462.9, Corn base 281.1 acres with yield index of 129 Bu. Soybean base 171.8 acres with yield index of 43 Bu. Wheat base 2.8 acres with yield index of 51 Bu. Direct USDA payment of $11,455/yr. CRP payment of $961/yr expiring 2008.
EASEMENTS: Sale of the property is subject to any and all easements of record.
MINERAL RIGHTS: The sale shall include 100% of the mineral rights owned by the Seller.
