PROPERTY LOCATION:2.5 mi. southwest of Hagerstown, IN on Bear Creek Rd. From Hagerstown west on Hwy. 38 to Brick Church Rd. then south 1.5 mi. to Bear Creek Rd. then west 1/2 mi. to the property on the left. Tract 4 is on Lost Mile Road.

PROPERTY DESCRIPTION:
Tract 1: 22 acres all cropland. Crosby soils and approx. 1,200 ft. of frontage on Bear Creek Road.
Tract 2: 38 acres all cropland. Crosby and Treaty soils and approx. 810 ft. of frontage on Bear Creek Road. Combine with Tract 1 for good 60 acres.
Tract 3: 25 acres all cropland. 679 ft. of frontage on Bear Creek Road.
Tract 4: 23 acres all cropland. 1,000 ft. of frontage on Lost Mile Road.
Tract 5: 14 acres (Swing Tract) all cropland. This tract must be bid in combination with Tract 2 or 4 or adjoining property owner.
AUCTION TERMS & CONDITIONS:
PROCEDURES: The property will be offered in 5 individual tracts, any combination of tracts, or as a total 122 acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations and the total property may compete. Tract #5 may be bid only by adjoining landowner or in combination with Tracts #2 & #4.
DOWNPAYMENT: Real Estate 10% down payment on the day of the auction with the balance in cash at closing. The down payment may be made in the form of cash; cashiers check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: Successful bidder(s) will be required to enter into a purchase agreement at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.
EVIDENCE OF TITLE: Sellers shall provide an owners title insurance policy in the amount of the purchase price.
DEED: Sellers shall provide Warranty Deed.
CLOSING: The balance of the real estate purchase price is due at closing, which will take place within 15 days of presentation of title policy or estimated before January 15, 2008.
POSSESSION: At closing subject to 2007 crop rights. Buyer to receive 2008 crop rights.
REAL ESTATE TAXES: Estimated at $15/acre. Buyer to pay taxes beginning May 2008 and thereafter.
ACREAGE: All boundaries are approximate and have been estimated based on current legal descriptions.
SURVEY: A new survey will be made where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Buyer(s) and Seller will share survey expense 50:50. Combination purchases will receive a perimeter survey only. Closing prices will be adjusted to reflect any differences between advertised and surveyed acreages.
FSA INFORMATION: Farm #6414, Tract #28597 - Henry County. Total 128.9 acres cropland. *Note: includes other cropland. Corn base of 85.7 with yield of 120 Bu. and Soybean base of 41.1 with yield of 34 Bu. Direct payment of $2,978/yr.
EASEMENTS: Sale of the property is subject to any and all easements of record.
MINERAL RIGHTS: The sale shall include 100% of the mineral rights owned by the Seller.
