    AUCTION TERMS & CONDITIONS:


    PROCEDURE: The property will be offered in 18 tracts, any combination of tracts and as a total unit. The property will be sold in the manner resulting in the highest total sale price.

    DOWN PAYMENT: Ten percent (10%) down payment upon signing of purchase agreement immediately following the close of bidding. The down payment may be made in the form of cash, personal check, business check or cashier's check. The remainder of the purchase price is payable in cash, cashier's check, certified funds, or bank draft at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.

    BUYER'S PREMIUM: A 5% Buyer's Premium will be added to the high bid to arrive at the contract selling price.

    ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into a purchase agreement at the auction site immediately following the close of the auction. All final bid prices are subject to acceptance or rejection by the Seller.

    CLOSING: The balance of the purchase price is due at closing, which will take place 30 days after Auction, or as soon thereafter as closing documents are completed.

    POSSESSION: Possession of the land will be given at closing.

    EVIDENCE OF TITLE: Seller shall provide an Owner's Policy of Title Insurance in the amount of the purchase price.

    DEED: Seller shall provide a Warranty Deed conveying the real estate to the Buyer(s).

    REAL ESTATE TAXES: Seller shall pay the Real Estate tax installment due in May 2008. All subsequent taxes will be the Buyers responsibility.

    ACREAGE: All acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.

    SURVEY: AT THE SELLER'S OPTION, the Buyer and Seller shall provide 50:50 of the survey cost for any parcel where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Any need for a new survey shall be determined in the sole discretion of the Seller. If a survey is determined by the Seller to be necessary, final bids will be adjusted to reflect the results of said survey. The type of survey prepared shall be determined by the Seller so long as it is sufficient for issuance of a title policy. Combination purchases will receive a perimeter survey only.

    EASEMENTS: Sale of the property is subject to any and all easements, covenants, restrictions, and assessments whether or not of record. There shall be easements granted in favor of the appropriate tracts to provide ingress and egress and for utility placement. The easements shall be 30' in width and will be over Pine Lakes Road, Oakridge Road, Angler Road and Deer Run as illustrated on the aerial tract map.

    SHARED LAKE RIGHTS: In the event Tracts 7 & 8 sell separately, each owner shall have the right to use the water surface of Long Lake and existing boat ramp.
