PROPERTY LOCATION:North of SR 6, east side of Kendallville, travel north on Riley Road approx. 1 1/2 miles to Appleman Road (800N), then east 1/4 mile to property.

PROPERTY DESCRIPTION:
TRACT 1: 5 ACRE potential building site. Approximately 400 ft. of frontage on 800 N. This tract is level with elevation overlooking the field behind it.

Tracts 3, 4, 5, 6, 7, and 14, per Kendallville planning and zoning, would require to receive a variance to be buildable sites. AUCTION TERMS & CONDITIONS:
PROCEDURE: The property will be offered in 17 individual tracts, any combination of tracts subject to the swing tract limitations, and as a total unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations and the total property may compete.
DOWN PAYMENT: 10% down payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cash, cashier's check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Seller's acceptance or rejection
EVIDENCE OF TITLE: Seller shall provide an owner's title insurance policy in the amount of the purchase price.
DEED: Seller shall provide General Warranty Deed(s).
DEED RESTRICTIONS: All single family homes must be built to the Indiana 1 & 2 Family Dwelling Code. (This would exclude all mobile homes and typical doublewide modular homes.) The minimum square footage on single story, single family homes shall be 1,250 square feet. The minimum square footage on 1-1/2 story single family homes shall be 1,500 square feet. The minimum square footage on 2 story, single-family homes shall be 1,750 square feet.
CLOSING: The balance of the purchase price is due at closing, which will take place within 15 days of presentation of insurable title. Costs for an insured closing shall be shared 50:50 between Buyer(s) and Seller.
POSSESSION: Possession shall be at closing, immediately following the closing, except on grain bins which will be April 30th.
REAL ESTATE TAXES: The Seller shall pay the 2007 taxes due in 2008. Buyer(s) shall assume and pay all taxes thereafter.
ACREAGE: All tract acreage, dimensions and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.
SURVEY: The Seller shall provide a new survey where there is no existing legal description or where the tract divisions in this auction create new boundaries. Solely the Seller shall determine any need for a new survey. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. The type of survey performed shall be at the Seller's option and sufficient for providing title insurance. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres, if a new survey is determined to be necessary by the Seller, on all tracts and tract combinations advertised as greater than 15 acres. Combination purchases will receive a perimeter survey only.
DRAINAGE EASEMENT: If tracts 1 - 5 and Tract 6 - 17 do not sell as entire properties respectively, easement access will be provided over tracts in this property for perimeter drain tile outlets if perimeter drain tile outlets beyond each individual tract are required by the Noble County Board of Health.
