    PROPERTY DESCRIPTION:


    Tract 1: A 20+ Acre tract of land with frontage on US 421 and along the McKillip Ditch. This tract is mostly all tillable land.

    Tract 2: This 75+ Acre tract also has frontage on US 421 and CR 675 N. This tract is mostly all tillable land. tracts 1 & 2 have many possibilities with frontage along US 421

    Tract 3: This tract is 24+ Acres with frontage on CR 675 N, CR 100 W. and along the McKillip Ditch. This tract has 20.89 Acres of tillable land per FSA.

    Note: A consideration would be to combine tracts 1,2 & 3 with 111.13 acres of cropland per the FSA office.

    Tract 4: A wonderful opportunity to purchase a 28+ Acre tract with a potential building site. Contains 18.91 acres of cropland per FSA, and your own private woods next to the McKillip Ditch. Tract 4 has frontage along CR 100W.

    Tract 5: This 57+ Acre tract has frontage on Cr 100 W & Park Rd. This tract contains 42.05 of tillable land per FSA and a wooded area on east side of this tract.

    Tract 6: This 3.3+ acre tract has frontage on Park Road and a small creek on the south boundary. This tract has 3+ acres of tillable land.






    AUCTION TERMS & CONDITIONS:


    PROCEDURE: The property will be offered in 6 individual tracts, any combination of tracts, and as a total 207+ acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations and the total property may compete.

    BUYER'S PREMIUM: A 2% Buyer's Premium will be added to the final bid price to determine the contract purchase price.

    DOWN PAYMENT: Real Estate 10% down payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cash, cashier's check, personal check, or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.

    ACCEPTANCE OF BID PRICES: Successful bidder(s) will be required to enter into purchase agreements at the auction site immediately following the close of the auction. All final bid prices are subject to Sellers acceptance or rejection.

    EVIDENCE OF TITLE: Preliminary title insurance policies will be available to Buyers prior to the auction inspection dates. The Seller will provide title insurance in an amount equal to the contract purchase price.

    DEED: Sellers shall provide a Co-Personal Representative's Deed.

    DRAINAGE TILE AGREEMENT: The buyer of Tract 1 will sign a Drainage Tile Agreement with the owner of the adjacent home allowing the owner of the home to fix or repair the drainage tile from the home to the ditch.

    CLOSING: Closing will be 30-60 days following the auction. The title company's fee for administering closing shall be shared 50:50 between Buyer and Seller.

    POSSESSION: On date of closing, subject to completion of survey if the property sells in tracts.

    REAL ESTATE TAXES: Buyer will pay the May 2009 real estate taxes and May 2008 ditch taxes, if any. According to the White Co. Treasurer's Office, the 2006-2007 Real Estate taxes were approx. $3,110 (this included the house and 1.75 Acres and 4.662 Acres on the east side of US 421).

    ACREAGE: All boundaries are approximate and have been estimated based on current legal descriptions.

    SURVEY: A new survey will be made where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Buyer(s) and Seller will share survey expense 50:50. Combination purchases will receive a perimeter survey only. Closing prices will be adjusted to reflect any difference between advertised and surveyed acres.

    EASEMENTS: Sale of the property is subject to any and all easements of record.

    MINERAL RIGHTS: The sale shall include 100% of the mineral rights owned by the Seller.

    AGENCY: Schrader Real Estate & Auction Company, Inc. and their representatives are the exclusive agents of the Seller.
