PROPERTY DESCRIPTION:The property consists of 9 irrigated quarters of which 7 are enrolled in CRP. 920.2 acres of CRP, 260.5 cropland, approximately 630 acres of pasture with the balance being native grasses and recreational land.
Tract 7 includes a steel building (40ft x 75ft) with a 16ft door and concrete pads from existing 200,000-bushel grain facility located on Hwy 20.
Real Estate taxes for 2007 total $9,509.
Primary soil types are Simeon and Valentine.
All nine irrigation wells are in compliance and detailed information is available upon request.
Access to Tracts 1 through 6 are via a recorded easement from Hwy 20.
Tracts 2 and 5 each include a small portion or recreational land with excellent hunting.
AUCTION TERMS & CONDITIONS:
PROCEDURE: The property will be offered in 7 individual tracts or any combination of tracts. The property will be sold in the manner resulting in the highest total sale price.
DOWN PAYMENT: A 10% down payment of the total contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of personal check, business check, or cashiers check. The balance of the contract purchase price is due in cash at closing within 30 days. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING.
ACCEPTANCE OF BID PRICES: All successful bidders will sign a purchase agreement at the auction site immediately following the close of bidding. All final bid prices are subject to the Sellers acceptance or rejection.
BUYER BROKER PARTICIPATION: A commission will be paid to any properly licensed Buyer Broker who registers a successful buyer according to the Broker Participation Guidelines. Broker Registration Forms are available upon request. Forms must be completed and returned no later than 48 hours prior to the auction.
CLOSING: Closing shall take place 30 days after auction day, or as soon thereafter as applicable closing documents are completed. Anticipated closing date is on or before April 25, 2008.
POSSESSION: Possession will be given at closing.
TITLE: Seller shall provide an Owners Policy of Title Insurance in the amount of the purchase price, and shall execute a proper deed conveying the real estate to the buyer(s). The premium for the title insurance policy shall be split equally between the Buyer and Seller.
REAL ESTATE TAXES AND ASSESSMENTS: The 2007 calendar year taxes payable in 2008, shall be paid in the form of a credit to Buyer at closing. Buyer will be responsible for all taxes and assessments thereafter.
CRP CONTRACTS: Buyer agrees to assume and shall maintain the CRP contracts currently in place and indemnify Seller from loss or claims due to Buyers non-assumption, forfeiture or non-renewal of the said contracts. Buyer will execute a CRP-1 Successor Contract at closing. 2008 CRP payments will be paid to the Buyer.
EASEMENTS AND LEASES: Sale of said property is subject to any and all easements of record and any and all government leases. Please contact the auction company for details.
SURVEY: AT THE SELLERS OPTION, the Seller shall provide a new survey where there is no existing legal description. Any need for a new survey shall be determined solely by the Seller. The cost of the survey will be split equally between the Buyer and Seller if a survey is needed. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance.
MINERAL RIGHTS: The sale of the property shall include all mineral rights owned by the Seller, if any.
AGENCY: Westchester Auctions, LLC and its representatives are Exclusive Agents of the Seller.
