    Note: The tillable land is in The Crop Reserve Program (CRP). The land shall remain in the program until the end of the contract period (ending in 2011) with the Farm Service Agency (FSA). Any income shall be paid to the buyers by the FSA after closing. Buyers purchasing land in the CRP program shall sign an agreement to keep the land in the program. If the buyer removes any CRP land from the program, any fees or penalties shall be paid by the buyer with no liability to the seller.

    PROPERTY DESCRIPTION:

    TRACT #1: 7.5 Acres. Nearly all wooded, great potential building site, wildlife & recreation. Approximately 340 ft. of road frontage on CR 750 S .
    TRACT #2: 9.5 Acres. Mostly wooded, potential building site, excellent hunting, small area in CRP. Approximately 430 ft. of road frontage.
    TRACT #3: 10 Acres. Approximately 4 acres wooded along the road and approximately 6 acres of tillable land with CRP income. Excellent potential building site and approximately 450 ft. of road frontage.
    TRACT 4#: 23.5 Acres. Small wooded area along the road, with the balance tillable with CRP income. Potential building site and recreation. 100 feet of road frontage.

    AUCTION TERMS & CONDITIONS:

    PROCEDURE: Tracts 1-5 will be offered in individual tracts. There will be open bidding on all tracts and combinations during the auction as determined by the auctioneer. The property will be sold in the manner resulting in the highest total sale price.
    DOWN PAYMENT: 10% of the accepted bid as down payment on the day of the auction with balance in cash at closing. The down payment may be in the form of cash, cashiers check, personal check or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING.
    APPROVAL OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.
    DEED: Seller will provide a warranty deed.
    EVIDENCE OF TITLE: Seller will provide title insurance in the amount of the purchase price.
    CLOSING: Closing shall take place 15 days after proof of merchantable title.
    POSSESSION: At closing.
    REAL ESTATE TAXES: The Seller shall pay the 2008 real estate taxes, due in 2009. The Buyer shall pay all taxes thereafter.
    DITCH ASSESSMENTS: The Buyer shall pay any ditch assessments after closing.
    SURVEY: The Seller shall determine any need for a new survey. Any new survey provided shall be for the perimeter only, when tracts are combined. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres, except on tracts of 11 acres or less. The survey costs shall be shared 50:50 between Buyer(s) and Seller.
    EASEMENTS: The sale of the property is subject to any and all easements of record. A perimeter tile drainage easement shall be given to buyers of building sites and existing homes.
