AUCTION TERMS & CONDITIONS:
PROCEDURE: The property will be offered in 1 individual tract.
DOWN PAYMENT: 10% down payment on the day of auction for individual tracts or combinations of tracts. The down payment may be made in the form of cashier's check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. Purchase agreements are available for review prior to the auction. All final bid prices are subject to the Sellers' acceptance or rejection in its sole discretion.
EVIDENCE OF TITLE: The Seller shall provide an owner's title insurance policy in the amount of the purchase price.
DEED: Seller shall provide proper deed conveying the real estate to the Buyer.
CLOSING: Closing shall take place within 30 days after auction day, or as soon thereafter as applicable closing documents and title insurance are completed. Costs for an insured closing shall be shared 50:50 between Buyer and Seller.
REAL ESTATE TAXES: Taxes shall be pro-rated to the day of closing.
POSSESSION: Buyer shall receive ownership 30 days after final closing.
SURVEY: The seller shall provide a survey of the property.
MINERAL RIGHTS: Seller shall convey its entire interest in the property including all mineral rights, if any, in the property owned by the Seller.
EASEMENTS: Sale of the property is subject to any and all easements of record.
AGENCY: Schrader Real Estate & Auction Company, Inc. and its representatives are exclusive agents of the Seller.
