TRACT DESCRIPTIONS

Tract 1: 145± ac Outstanding tract featuring two very nice farm ponds and a small cabin. This tract contains a lot of hunting ground and grazing ground. There is electrical utility and two septic tanks. Many beautiful potential home sites. There is a small family cemetery. Roads and trails throughout the tract which is mostly wooded and great for hunting. 7/10 mile of paved road frontage.

Tract 2: 196± ac Many beautiful potential home and pond sites. Mostly good laying ground with a few small fields that are kept mowed. Contains a lot of wooded area with mostly young growth timber. This tract contains a lot of hunting ground. Roads and trails throughout the tract. Road frontage along Ridge Road.

Tract 3: 149± ac All wooded with mostly young timber growth. 6/10 mile of road frontage with many potential home sites. Access roads and trails throughout making it great for ATV riding and hunting.

Tract 4: 100± ac All wooded with young timber growth. Situated at the end of an access road. 3/10 mile road frontage with and accessible from Route 1021. Contains a lot of flat ridgetop for grazing fields. Very nice scenic view.

Has road frontage on Route 1021. Access road on back side leads to Ridge Road Route 784. Some road frontage on Route 784.

Tract 7: 72± ac Contains an access road off of Ridge Road Route 784. This tract has a long ridgetop overlooking valleys on three sides. Route 1021 is situated on one side, with a total of 1 mile of paved road frontage. Most of the tract is covered in young timber growth with some larger timber in the valleys. There is a nice view from the ridgetop. Contains a lot of acreage for food plots. Great spot for deer hunting.

Tract 8: 74± ac This tract contains young timber growth. Most of the tract has 3/10 mile of road frontage on one side along Route 1021 and Ridge Road 784. The ground lays nice on ridgetop with a steeper side to Route 1021. There is a great spot for a potential cabin site on the ridgetop with an excellent view to Briar Hollow.

Tract 9: 109± ac A very unique tract featuring a long access road leading to a closed former clay mine works. The clay mine works was used approximately 100 years ago for brick making. Tract 12: 39± ac Lays in a small valley with access and one-half mile of road frontage at the top along Ridge Road Route 784 and road frontage and access along Horse Hollow Road at the bottom of the valley. PROCEDURE: The property will be offered in seventeen (17) individual tracts, any combination of two (2) or more tracts, and as one (1) entire tract at the date and time noted in this brochure. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneers. Bids on tracts, tract combinations, and the entire tract may compete.

DOWN PAYMENT: A ten percent (10%) down payment is required on the day of the auction with the balance due at closing. The down payment may be made in the form of cashiers check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING SO BE SURE TO HAVE ARRANGED FINANCING, IF NEEDED, AND THAT YOU ARE CAPABLE OF PAYING BALANCE AT CLOSING.

BUYERS PREMIUM: A three percent (3%) Buyers premium will be added to the final bid price and included in the total purchase price.

ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into a Real Estate Purchase Contract at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.

DEED: Seller shall provide a Limited Warranty Deed to Buyer(s) at closing.

EVIDENCE OF TITLE/CONDITION: Seller agrees to furnish bidders a preliminary title insurance commitment for Buyers review, prior to the auction. Seller agrees to provide merchantable title to the property, subject to existing public highways and streets, easements, covenants, conditions, restrictions and reservations of record, if any; zoning and other governmental regulations and restrictions; and non-delinquent real estate taxes and assessments. Buyers will be responsible for purchasing any owners or lenders policy required. All tracts will be sold AS IS WHERE IS, WITH ALL FAULTS.

REAL ESTATE TAXES: Real Estate Taxes shall be pro-rated to the date of closing.

CLOSING: The balance of the purchase price is due at closing, targeted closing date will be approximately 30 days after the auction, or as soon thereafter as applicable closing documents are prepared by the Seller. Costs for an administered closing shall be shared 50:50 between Buyer(s) and Seller. All lender costs relative to the Buyer securing a mortgage shall be paid by the Buyer(s).

POSSESSION: Possession shall be delivered at closing; Buyers may acquire a hunting lease for temporary access immediately following the Auction and expiring at the closing or termination of the transaction.

ACREAGE: All tract acreages, dimensions, and boundaries are approximate and have been estimated based on current legal descriptions.

SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Any need for a new survey shall be determined solely by the Seller. Seller and successful bidder shall each pay half (50:50) of the cost of the survey, Buyers share not to exceed $1,000 per tract. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance. Combination purchases will receive a perimeter survey only.

PROPERTY INSPECTION: Each potential bidder is responsible for conducting, at their own risk, independent inspections, investigations, inquiries, and due diligence concerning the property. Inspection dates have been scheduled and will be staffed with auction personnel. Each potential bidder shall be liable for any property damage caused by any such inspections or investigations.
