TRACT DESCRIPTIONS
Tract 1: 45± ac fronting St. Hwy 96 and Dutch Creek Road. Mostly wooded with open areas, good elevation, great views of Mississippi River bottoms.
Tract 2: 65± ac fronting St. Hwy 96 mostly wooded with elevated food plot areas and approximately 10 acres tillable.
Tract 3: 74± ac fronting St. Hwy 96, great views, good access, elevation, road to upland food plot areas.

PROCEDURE: Tracts 1 through 3 will be offered in individual tracts, in any combination of these 3 tracts, or as a total property. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations, and the total property may compete.
DOWN PAYMENT: 10% of the Contract Purchase Price as down payment on the day of auction with the balance in cash at closing. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
OWNER FINANCING: The Seller will offer a financing opportunity as follows: 20% cash down payment, 7.5 per annum interest rates, 20 year amortization w/ a balloon payment in 5 years. Buyer will be required to elect or decline owner financing immediately upon acceptance of his offer.
BROKER PARTICIPATION: Qualified Brokers may registers with the Auction Company clients and receive a fee equal to 2% of the high bid amount on closed transactions. The Broker must follow the Broker Participation Guidelines. Go to www.schraderauction.com for guidelines.
BUYERS PREMIUM: The Buyers Premium of 3% will be charged to the Buyer. The Buyers premium shall be added to the high bid to obtain the Contract Purchase Price.
APPROVAL OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auction site immediately following the close of the auction. Bids are subject to acceptance or rejection by the Owner.
DEED: Seller will convey by Warranty Deed(s).
EVIDENCE OF TITLE: The Owner agrees to furnish at Owners expense a Title Insurance Policy. A preliminary commitment will be available for review prior to the auction.
CLOSING: The closing shall take place 30 days after the auction day, or as soon thereafter as applicable closing documents are completed by Seller.
POSSESSION: Possession at closing.
MINERAL RIGHTS: All mineral rights owned by the Seller, if any, shall be conveyed.
REAL ESTATE TAXES: The 2008 calendar year taxes due in 2009 shall be paid by the owner at closing. The 2009 taxes due in 2010 shall be paid by the buyer.
ACREAGE AND TRACTS: All acreages are approximate and have been estimated based on current legal descriptions and/or aerial photos. Any corrections, additions, or deletions will be made known prior to the auction.
SURVEY: Owner shall provide a survey for any tract where there is no existing legal description or where new boundaries are created by the tract division for the auction. Any need for a new survey shall be determined solely by the Owner. If a new survey is determined to be necessary, the Owner and the Buyer(s) shall share the cost of the said surveys (50:50). The type of survey prepared shall be determined by the Owner so long as it is sufficient for issuance of the title insurance policy. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres on any tracts or combination of tracts that require a survey.
PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. Inspection dates have been scheduled and will be staffed with auction personnel.Owner and Auction Company disclaim any and all responsibility for Buyers safety during any physical inspection of the property.
AGENCY: Schrader Auction Co. and its representatives are exclusive agents of the Seller. There shall be no subagency.
