Tracts 1-3: are located approximately 20 miles north of Garden City, KS along the west side of US Hwy 83. Tracts 4 & 5: are located approximately 14 miles north of US Hwy 50 on Big Lowe Rd and four miles west on Gano Rd. Tracts 6-22: are located approximately 15 miles southeast of Garden City, KS just south of Pierceville on S Pierceville Rd. Each auction tract is marked with signs.

PROPERTY DESCRIPTION
Tracts 1-3: The soil type on these tracts is predominantly Ulysses silt loam and real estate taxes are approximately $2.50 per acre. There is a lease currently in place on these tracts. Mineral and wind rights are included.
Tracts 4 & 5: Soil type is primarily Richfield silt loam and real estate taxes are approximately $2.50 per acre. These tracts are leased through November 1, 2014. Minerals are not included but wind rights will transfer with the property.
Tracts 6-22: The primary soil types are Valent-Vona loamy fine sand and Las Animas sandy loam. Real estate taxes range from $1.44 to $2.39 per acre in Finney County and are approximately $4.15 per acre in Gray County.
The irrigated tracts each include one irrigation well. Please contact the auction company for detailed water information. The irrigation equipment is owned by the tenants and will not be sold at the auction.
Tracts 6, 8, 15, 17 & 19 are leased through 12/1/2011.
Tract 7 is leased through 12/1/2010.
Tracts 16, 18, 21 & 22: There is a lease currently in place on these tracts.
Non-producing minerals, if any, are included on all tracts. Any producing minerals will be sold separately. All wind rights will be transferred with auction tracts.

PROCEDURE: The property will be offered in 30 individual tracts (22 land tracts and 8 mineral tracts), any combination of tracts, or as a whole property. The property will be sold in the manner resulting in the highest total sale price.
DOWN PAYMENT: A 10% down payment of the total contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of personal check, business check, or cashiers check. The balance of the contract purchase price is due in cash at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING.
ACCEPTANCE OF BID PRICES: All successful bidders will sign an Agreement to Purchase at the auction site immediately following the close of bidding. All final bid prices are subject to the sellers acceptance or rejection.
BROKER PARTICIPATION: A commission will be paid to any properly licensed Broker who registers a successful buyer according to the Broker Participation Guidelines. Broker Registration Forms are available from the Auction Company. Forms must be completed and returned no later than 48 hours prior to the auction.
CLOSING: Anticipated closing date is on or before November 22, 2010.
TITLE: Seller shall furnish the buyer(s) at Sellers expense an Owners Policy of Title Insurance in the amount of the purchase price, and agrees to provide and execute a proper deed conveying merchantable title to the real estate to the buyer(s).
REAL ESTATE TAXES AND ASSESSMENTS: The 2010 calendar year taxes shall be paid by the Seller. Buyer will be responsible for all subsequent taxes. Special assessments, if any, shall be paid by Buyer.
SURVEY: AT THE SELLERS OPTION, the Seller shall provide a new survey where there is no existing legal description. Any need for a new survey shall be determined solely by the Seller unless such surveys are required by State or local law. The cost of the survey shall be paid by the Seller. The type of survey performed shall be at the Sellers option and sufficient for providing title insurance and the transfer of merchantable title.
MINERAL RIGHTS: Non-producing minerals, if any, are included on all tracts. Any producing minerals will be sold separately.
AGENCY: Westchester Auctions, LLC and its representatives are Exclusive Agents of the Seller.
