TRACT DESCRIPTIONS

Tract 1: 77± ac of mostly tillable land with a mix of Pewamo and Blount soils. Extensively systematically tiled and frontage on SR 26.

Tract 2: 39.7± ac with 38 tillable acres per FSA and a mix of productive Pewamo and Blount soils. Systematically tiled and access via Division Road off of 500 W.

Tract 3: 116.7± ac with 102.3 tillable acres per FSA and a high percentage of Pewamo soils. This tract includes extensive tiling and frontage on SR 26 and County Road 600 W.

Tract 4: 101.1± ac acres of mostly tillable land with primarily Pewamo and Blount soils. Systematically tiled and abundant frontage on SR 26. When the SR 26 project is completed, the northeast corner will be adjusted. The state has purchased the land and the advertised acreage reflects the purchase. Tract 5: 79.3± ac with 78.4 tillable acres per FSA and primarily Pewamo soils. Extensively tiled with frontage on SR 26.

PROCEDURE: The property will be offered in 6 individual tracts, any combination of tracts and as a total 493 acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations and the total property may compete.

DOWN PAYMENT: 10% down payment on the day of auction for individual tracts or combinations of tracts. The down payment may be made in the form of cashier’s check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.

ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers’ acceptance or rejection.

EVIDENCE OF TITLE: Seller shall provide an owner’s title insurance policy in the amount of the purchase price.

DEED: Seller shall provide a Warranty and/or Trustee’s Deed.

CLOSING: The balance of the purchase price is due at closing, which will take place within 15 days of presentation of insurable title. Costs for an administered closing shall be shared 50:50 between Buyer(s) and Seller.

POSSESSION: Possession is at closing. Immediate possession for normal farming practices with a 20% earnest money deposit.

REAL ESTATE TAXES: Real estate taxes will be the responsibility of the Buyer(s) beginning with taxes due for 2011 payable in 2012 and any ditch taxes due in 2011 and thereafter.

ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.

SURVEY: A new survey will be ordered only if needed for good title insurance policy as determined by the seller and the cost of the new survey will be split 50:50 between buyer and seller.
