Tract 1: 23.5± ac This Tract is on the Western edge of the property and has approximately 385ft of road frontage. There are 10+/- acres of woods to the back with the balance being mostly tillable. There is the CL Hamm ditch with a 75ft wide ditch easement between the tillable and wooded acreage. The terrain slopes down to the ditch and rises back up towards the back.

Tract 2: 23.5± ac This tract is in the center of the property and has approximately 385ft of road frontage. It also has 10+/- acres of woods to the back with the balance being mostly tillable. The CL Hamm ditch with the 75ft easement also divides the tillable and wooded acreage on this tract. The terrain is the same as Tract 1.

Tract 3: 23± ac This tract is on the Eastern edge of the property and has approximately 543ft of road frontage. This tract's North property line is at the center of the Hamm ditch. This tract is mostly all tillable, except the front edge of the ditch.

Tract 4: 10± ac SWING TRACT: This tract is a swing tract and can only be bid on in combination with adjacent tract or by an adjacent land owner. It is mostly tillable with the Hamm ditch being the Southern border. The terrain slopes up to the North from the ditch. There is a 12ft wide 4 rail i-beam bridge that crosses the ditch. The deck needs to be repaired or replaced. Do not drive vehicles over it.




PROCEDURE: Tracts 1-4 will be offered in individual tracts, and in any combination of these tracts, or as a total unit, subject to Swing Tract rules. There will be open bidding on all tracts and combinations during the auction as determined by the auctioneer. The property will be bid in the manner resulting in the highest total sale price.

DOWN PAYMENT: 10% Cash down payment at close of auction. Cash or cashier's check or a personal or corporate check immediately negotiable is satisfactory for the down payment. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING.

APPROVAL OF BID PRICES: At the close of the auction, Buyer(s) will be required to execute an Agreement to Purchase Real Estate and Addendum. Seller reserves the right to reject any and all bids. The terms of this agreement and addendum are non-negotiable.

DEED: Seller shall provide a warranty deed and Owner's Title Insurance Policy.

EVIDENCE OF TITLE: Seller shall provide title insurance in the amount of the purchase price.

CLOSING: Balance of purchase price is due in cash at closing, which will take place on or before July 31, 2021. The cost for an insured closing will be shared 50/50 between Buyer and Seller.

POSSESSION: Possession is at closing, subject to tenant farmer 2021 crops. Seller to receive proceeds from 2021 crop and government payments related to the 2021 growing season.

REAL ESTATE TAXES: The Real Estate Taxes shall be pro-rated to the date of closing.

DITCH ASSESSMENTS: Buyer shall pay all ditch assessments due after closing.

ACREAGE: All acreage is approximate and has been estimated based on current legal descriptions and/or aerial photos.

SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in the auction. Any need for a new survey will be determined solely by the Seller, cost of the survey will be split 50/50 between Buyer and Seller. The type of survey performed shall be at the Seller's option and sufficient for providing title insurance. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres.

EASEMENTS: All real estate is being sold subject to any existing recorded easements. Existing recorded leases, if any will be assigned to the Buyer.
