From Interstate 25 take the Hwy 14 exit at Fort Collins and go west on Hwy 14 to Hwy 287 (College Ave). Take Hwy 287 north 21 miles to Livermore (look for The Forks Restaurant).Turn left onto County Road 74E (Red Feather Lakes Road). Travel approximately 24 miles to Red Feather Lakes and go past the Pot Belly Restaurant to the end of 74E and the junction of County Roads 162 and 73C. Follow the paved road as it bends to the right (north) turning into County Road 73C (Creedmore Lakes Rd). After 1 mile 73C will turn into a dirt road. PROCEDURE: The property will be offered in 19 individual tracts. Tracts 1-7, 14, 17, and 19 may be combined in any combination. Tracts 8-13 may be combined in any combination. Tracts 15 and 16 may be combined. Tract 18 cannot be combined with any other tract. The property will be sold in the manner resulting in the highest total sale price.
BUYER’S PREMIUM: A ten percent (10%) Buyer’s premium will be added to the final bid price to arrive at the total contract purchase price paid by the Buyer(s).
DOWN PAYMENT: A 10% down payment of the total contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of personal check, business check, or cashier’s check. The balance of the contract purchase price is due in cash at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING.
ACCEPTANCE OF BID PRICES: All successful bidders will sign a purchase agreement at the auction site immediately following the close of bidding. All final bid prices are subject to the seller’s acceptance or rejection.
BUYER BROKER PARTICIPATION: A commission will be paid to any properly licensed Buyer Broker who registers a successful buyer according to the Broker Participation Guidelines. Broker Registration Forms are available from the Auction Company. Forms must be completed and returned no later than 72 hours prior to the auction.
CLOSING: Closing shall occur as soon as possible after applicable closing documents have been completed. Anticipated closing date is on or before August 31, 2010. Possession shall be at closing subject to tenant’s rights.
TITLE: Seller shall provide an Owner’s Policy of Title Insurance in the amount of the purchase price, and shall execute a proper deed conveying the real estate to the Buyer(s). Seller shall pay the premium of the title insurance policy.
REAL ESTATE TAXES AND ASSESSMENTS: The 2010 calendar year taxes shall be prorated to the date of closing and shall be paid by the Seller in the form of a credit to the Buyer(s) at closing. Prorations will be based on the 2009 tax information. Buyer(s) will be responsible for all subsequent taxes.
GRAZING LEASE: There is a grazing lease in place for tracts 1-7, 14, 17 and 19 which expires October 1, 2010.
EASEMENTS AND LEASES: Sale of said property is subject to any and all easements of record and any and all government leases.
MINERAL RIGHTS: The sale shall include all mineral rights owned by the Seller, if any.
AGENCY: Westchester Auctions, LLC and its representatives are Exclusive Agents of the Seller.
