TRACT DESCRIPTIONS

Tract 1: 59± ac with 53 +/- acres tillable. The balance is wooded land. This tract has road frontage on 800 S and includes the farm lane to access the back of the farm. With the back of the farm predominately Blount Silt Loam and Pewamo Silty Clay Loam soils.

Tract 2: 13± ac mostly all tillable with road frontage on 800 S & 500 W.

PROCEDURE: The property will be offered in 4 individual tracts and as a total 110 +/- acre unit. There will be open bidding during the auction as determined by the Auctioneer. Bids on individual tracts and the total property may compete.

DOWN PAYMENT: 10% down payment on the day of auction for individual tracts or combinations of tracts. The down payment may be made in the form of cashiers check, personal check, or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.

ACCEPTANCE OF BID PRICES: Successful bidder(s) will be required to enter into purchase agreement at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.

EVIDENCE OF TITLE: Seller shall provide an owners title insurance policy in the amount of the purchase price.

DEED: An appropriate deed will be delivered at closing.

CLOSING: Closing shall take place 30 days after auction date, or as soon thereafter as applicable closing documents are completed.

POSSESSION: At closing, which shall take place within 15 days of marketable title.

REAL ESTATE TAXES: Seller shall pay the 2012 real estate taxes due in 2013. The Buyer will assume the taxes due thereafter.

ACREAGE: All tract divisions are approximate acres.

SURVEY: A new boundary survey was completed in August 2012. If farm sells as a whole, no new boundary survey will be done and the cost of this survey will be split 50:50 between Buyer and Seller. If new boundaries are created by the tract divisions in this auction, Buyer(s) and Seller shall share survey expense 50:50.

EASEMENTS: Sale of the property is subject to any and all easements of record.

MINERAL RIGHTS: The sale shall include 100% of the mineral rights owned by the Seller.
